Warranty Terms: What’s Covered
Limited Hardware Warranty Policy “Warranty”
Conaqua warrants, to the original product purchaser, that your hardware product will be free from defects in workmanship and materials for the duration specified on your product packaging, and/or at www.conaqua.net, under your product’s specifications, starting from the date of purchase (or delivery, if required by specific jurisdictions). You can also find this information by selecting your product in the support section of our website. This warranty is nontransferable, except where prohibited by law, and is limited to the original purchaser and the country of purchase. This warranty provides you with specific legal rights, and you may have additional rights, including potentially longer warranty periods, depending on local laws.
If the product includes a rechargeable battery, Conaqua does not offer any warranties regarding battery life, as it is normal for all rechargeable batteries to lose charging capacity over time, and this is not deemed a defect. Your actual battery life may vary based on the usage conditions.
Exclusions and Limitations
This Limited Warranty does not cover:
- Software, including but not limited to: (i) the operating system and software added to Conaqua-branded hardware through our factory-integration system, (ii) third-party software, or (iii) the reloading of software, configurations, or data files;
- Non-Conaqua branded products and accessories, even if they are packaged and sold with the product;
- Issues or damage to the product caused by using accessories, parts, or components not manufactured by Conaqua;
- Lost parts that were originally supplied with the Conaqua hardware product;
- Damage resulting from service (including upgrades and expansions) performed by anyone not officially affiliated with Conaqua;
- Claims arising from improper use or care of the product, including but not limited to misuse, abuse, negligence, unauthorized modifications or repairs, unauthorized commercial use, or operation outside Conaqua’s recommended parameters;
- Incorrect operation or maintenance, use that does not follow the product instructions, or connection to an inappropriate voltage supply;
- Claims resulting from external factors, including but not limited to accidents, acts of God, liquid exposure, fire, or earthquakes;
- Products with altered, removed, or obliterated batch and/or serial numbers and/or date stamps;
- Products for which Conaqua does not receive payment; or
- cosmetic damage, minor cosmetic defects (such as minor color or pixel issues), and normal wear and tear, including scratches, dents, and chips.
Conaqua does not guarantee that the product will operate without interruption or errors. ALL SOFTWARE AND THIRD-PARTY PRODUCTS AND ACCESSORIES INCLUDED WITH THE PRODUCT ARE PROVIDED “AS IS.” You assume all risks regarding the quality, performance, accuracy, and effects of such items. Should any prove defective, you alone are responsible for all servicing or repair costs.
Remedies
If Conaqua receives an eligible claim under the Warranty within the applicable Warranty Period, Conaqua will, at its sole discretion, either: (a) repair the Product or defective parts at no cost, using new or refurbished replacement parts; or (b) replace the Product with a new one or one made from new or serviceable used parts that is at least functionally equivalent to the original Product. Products submitted for repair may be replaced with refurbished goods of the same type instead of being repaired, and refurbished parts may be used for repairs. Conaqua reserves the exclusive right to determine the eligibility of a claim and whether the Product is defective. If the Product is an “end of life” model, Conaqua may, at its discretion, replace the Product with a functionally equivalent model from its current range. Conaqua also reserves the right to offer other remedies in addition to or instead of the options listed above. Repaired or replaced Products are warranted against defects for ninety (90) days from the date of repair or replacement, or for the remainder of the original Warranty Period, whichever is longer.
Limitation of Liability
TO THE EXTENT ALLOWED BY LAW, CONAQUA WILL NOT BE LIABLE FOR ANY LOST DATA, LOST PROFITS, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES (EXCEPT FOR PERSONAL INJURY DAMAGES), WHETHER ARISING FROM CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, RESULTING FROM THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF CONAQUA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CONAQUA’S LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT. These limitations will apply even if any warranty or remedy provided under this Agreement fails to fulfill its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.
Starting a Claim
If you believe you may have a warranty claim, the first step is to visit conaqua.net/support. You can find a variety of Support and FAQ pages that offer valuable technical assistance.
If you can’t find a solution on our website, please reach out to the retailer where you made your purchase. Valid warranty claims are usually processed through the retailer from where you bought the product within the first thirty (30) days after the purchase. This timeframe may vary by retailer.
If your warranty claim cannot be handled through the retailer where you purchased the item, please follow the steps below. You may need to assist with the diagnosis process to help identify and confirm any issues you’re experiencing with the Product. Service options, availability of parts, and response times may vary depending on the country where the Warranty claim is submitted.
- Go to conaqua.net/support to obtain a Return Merchandise Authorization Number (“RMA Number”) and Conaqua support address.
- Note the RMA Number in a visible place on the outside of the package.
- Enclose a Valid Proof of Purchase (e.g. purchase receipt) and the reason for the return inside the package.
- Send the Product with RMA Number and Valid Proof of Purchase to the Conaqua support address provided by Conaqua customer support.
We recommend using a traceable shipping method (e.g., UPS, DHL, FedEx) when returning the Product. The person making the claim is responsible for all associated costs, including shipping and handling fees for returning the Product to Conaqua, as well as any applicable customs, duties, or taxes. If the Product is returned under the terms of this Warranty, Conaqua will cover the cost of shipping the Product back to you, though you will remain responsible for any customs charges, duties, or taxes. You are also responsible for ensuring the Product is properly packaged; Conaqua will not be liable for any loss or damage to improperly packaged returns. Risk of loss or damage to the Product remains with you until it is received by Conaqua. Conaqua is not responsible for items lost in transit. If the return procedure is not followed, Conaqua reserves the right to accept the returned Product on terms it deems appropriate, at its sole discretion.
Returns Not Covered by this Warranty
If Conaqua receives a Product that does not meet the conditions of this Limited Warranty, such as (a) lacking a valid RMA Number, (b) not being accompanied by a valid Proof of Purchase, (c) being outside the Warranty Period, or (d) not having a defect covered by this Limited Warranty, you may be charged an assessment fee, return shipping and handling costs, and any other reasonable fees Conaqua deems necessary before the Product is returned to you.
Consumer Law
This Limited Warranty provides you with specific legal rights, and you may have additional rights that vary depending on your country, province, or state. Except where prohibited by law, Conaqua does not exclude, limit, or suspend any other rights you may have. For a complete understanding of your rights, you should refer to the laws of your country, province, or state, as applicable.
Translation
This Limited Warranty may be translated into other languages. However, in the event of any discrepancy between the English version and any translated versions, the English version will always take precedence.
General
This Warranty applies solely to the original purchaser of the Product and is non-transferable. It is valid only in the country where the Product was originally purchased. If the Product was shipped internationally by an authorized reseller, the country of original purchase is considered to be the reseller’s shipping point. This Limited Warranty is governed by the laws of the country where the original purchase was made. No Conaqua reseller, agent, distributor, or employee is authorized to modify, extend, or add to this Limited Warranty. If any provision of this Limited Warranty is found to be illegal or unenforceable, the validity or enforceability of the remaining provisions will not be affected.
